Il prossimo 28 giugno l’avv. Maria Roberta Perugini parteciperà come relatrice a Milano al seminario “Introduzione al GDPR e analisi degli impatti di adeguamento”. Si tratta di una edizione rinnovata dell’incontro – già tenuto a marzo con grande interesse del pubblico – dedicato alla presentazione del modello di implementazione del GDPR (General Data Protection Regulation) proposto alle imprese dal team data protection di Jacobacci e Associati.

UN METODO PER LA COMPLIANCE - GDPR: nuova cultura nella protezione dei dati personali

Presentiamo il modello di implementazione del GDPR (General Data Protection Regulation) proposto alle imprese dal team data protection di Jacobacci & Associati: utilizziamo un approccio multidisciplinare (legale, governance, tecnico, organizzativo) per accompagnare l’impresa a definire un framework di implementazione del GDPR che possa poi attuare nel continuo in un contesto di autonomia.

L’obiettivo primario della metodologia utilizzata è infatti supportare il Cliente nel raggiungimento di una piena conformità al GDPR, che come tale non può prescindere da un buon livello di autonomia nella data governance, necessaria ad operare nel rispetto del principio di accountability.

WILL THE CONSENT COLLECTED BEFORE THE EFFECTIVE DATE OF GDPR STILL BE VALID?

This paper deals with the conditions for the consent obtained according with the Italian Privacy Code as a valid legal basis for data processing that continues after May 25, 2018: in concrete terms, does the consent properly collected according to the Privacy Code can also be considered valid under the GDPR regime and therefore constitute the appropriate legal basis for the treatment without need for collect a new one?

Personal data made public by the ‘data subject’ and use of information published on social networks: early observations of GDPR art. 9, para. 2, letter e)

Among the topics of current interest in the field of protection of personal data are the limits on use of the information published on social networks, especially in view of the regulatory changes introduced by the EU General Data Protection Regulation ("GDPR"). This article identifies the consequences of this issue arising from the exception on the prohibition of "processing special categories of personal data" (Art. 9 GDPR) for cases where the processing relates to "personal data which are manifestly made public by the interested party "(paragraph 2, lett. e).

The proposal for a Regulation on privacy and electronic communications is ready

On 10 January, the European Commission presented a proposal for a Regulation (hereafter, the “Regulation”) concerning the processing of personal data and the protection of privacy in electronic communications, aimed at repealing Directive 2002/58/EC (hereafter, the “ePrivacy Directive”).

This proposal for a Regulation updates the legislation currently in force, providing better protection of confidentiality in electronic communications – including through the alignment of legislation with the new world-class standard provided in the recent EU General Data Protection Regulation (GDPR) – and consequently contributing to the creation of new useful tools to facilitate international data exchanges in the digital economy, and therefore to the development of the digital single market.

CIPL Survey about GDPR

As is widely known, the European Union General Data Protection Regulation, which replaces Directive 95/46/EC, will come into force in May 2018 and will bring relevant changes to all stakeholders: DPAs, individuals, controller and processor organizations. In order to help organizations understand the key operational impacts of the regulation and to stimulate their internal change, the Centre for Information Policy Leadership – a global privacy and security think tank that works to advance privacy and security policy, law and practice – launched a survey (respondents were both data controllers and data processors of multinational organizations with an annual revenue size ranged from less than $1 million to more than $100 billion, that predominantly operated in Europe and in the US) to evaluate their progress towards true operationalization for GDPR readiness.
