The new Legislative Decree No. 26/2023 has implemented the EU Directive 2019/2161 (so-called Omnibus).
On 2 April 2023, the majority of the provisions come into force and, from 1 July 2023, the application of the transparency provisions on price reductions.
The main changes concern:
- Increased reporting and transparency obligations
- Personal data of users become a "consideration
- Expansion of so-called unfair commercial practices
- Changes to the right of withdrawal
- Tightening of the penalty system
